Terms and conditions of services to candidates

This page tells you the terms and conditions on which we supply any of the services  (Services) referred to on our website www.cambridgenetwork.co.uk/jobs (our site) to recruitment candidates.  Please read these terms and conditions carefully before using those Services.  You should understand that by requesting any of our Services, and/or registering with us, you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for future reference.

Please click on the button marked "Accept terms and conditions" if you accept these terms and conditions.  Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Services from our site or register with us.

The terms and conditions, privacy policy and disclaimer relating to use of the Cambridge Network website which you are deemed to acknowledge and accept by accepting these terms and conditions.

Please note that companies or other organisations who, with our agreement, post positions with us and/or use any other services provided by us will be subject to terms and conditions which will be separately notified.

1. INFORMATION ABOUT US

www.cambridgenetwork.co.uk/jobs is a site operated by Cambridge Network Limited ("We").  We are a limited company registered in England and Wales under company number 03400152 and have our registered office at The Quorum, Barnwell House, Cambridge CB5 8RE.  Our main trading address is The Entrepreneurship Centre, The Hauser Forum, 3 Charles Babbage Road, Cambridge CB3 0GT. 2. OUR SERVICES AND THE REGISTRATION PROCESS

2.1 The nature of our Services and the process for registration is set out in our site. 

2.2 After requesting registration, you will receive an e-mail from us acknowledging that we have received your request.  Please note that this does not mean that your request has been accepted.   All requests for registration are subject to you providing the information we have requested on the registration form and to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that you are registered. Registration will only be complete, and we will only begin providing Services to you, when we send you the email confirmation. All communications will take place in the English language.

2.3 Our site is intended for use by people resident in the United Kingdom. If you are resident outside the United Kingdom, you warrant and represent that the agreement of these terms and conditions by you and the provision of the Services to you does not breach the requirements of any country in which you are resident or located and that these terms and conditions are enforceable to the exclusion of any further terms.

3. YOUR STATUS AND INFORMATION YOU PROVIDE

3.1 Registering as a candidate with us, you warrant and represent that you are a private individual utilising the Services for bona fide purposes as a work seeker and are not an agency or using our site for the purposes of business or research. You also warrant and represent that you are at least 18 years old and legally capable of entering into binding contracts.
You will comply with our requirements concerning registration and security procedures (including without limitation maintaining secrecy of passwords) and will only create one, unique profile.

3.2 You warrant that all information provided by you to us or to companies and agencies and other organisations who post positions on our site (Hirers) is true, accurate and not misleading and does not infringe the rights of any third party and you will inform us immediately if any information provided becomes untrue or misleading. In particular, and without limiting the warranty above, you warrant that all biographical information and information concerning your qualifications, experience and employment history, is true, accurate and not misleading.


3.3 The circumstances applicable to particular Hirers or positions may require us to make enquiries of you, conduct checks and/or provide you with additional information. You will provide such further confirmations, information, documents (including without limitation documentary evidence of qualifications) and/or references as we reasonably request in order to enable us to provide our Services. This may include confirmations, information, documents and/or references required by Hirers (whether in respect of particular positions or generally) and/or which we are required to obtain by law. Failure to provide the confirmations, information, documents and/ or references may mean that we are unable to pass on your details to a Hirer or Hirers or to provide Services to you. Your attention is however drawn to clause 4.1 below.

3.4 By registering with us, you confirm that you are willing to work in the position(s) and for the Hirers in relation to which your details are submitted. You consent to disclosure of information about you both to Hirers and otherwise as set out on our site.

4. OUR LIABILITY

4.1 Our Services consist of the introduction of candidates to Hirers and we will use our best efforts to make those introductions in the manner described on our site. However, our site’s and our role is only to act as a means of allowing Hirers to post job opportunities and candidates to consider those opportunities and send their CVs and/or other personal details to Hirers. We are not involved in the transaction between Hirers and candidates and have no authority to act or speak on behalf of either Hirer or candidate. We shall have no responsibility for, and make no warranty or representation in relation to:

  • The accuracy of position listings and other information on our site;
  • The quality, safety or legality of positions posted;
  • Any failure for any reason, including our negligence, to pass on information to you or to Hirers;
  • Any information provided by any Hirer or other third party whether in a recruitment advertisement or otherwise;
  • Any action or omission by or any communication from any Hirer or other person acting on the Hirer’s behalf;
  • Verifying the identity of, vetting or screening the Hirer or any person who represents a Hirer, or vetting or screening any role offered by a Hirer or the content of any information the Hirer provides;
  • The suitability of the candidate for the role or for the Hirer and vice-versa;
  • The success of any introduction or the selection process undertaken by the Hirer or the outcome of that process;
  • Your safety and security in dealing with third parties;
  • Any failure to perform, or delay in performance of, any tasks that is caused by events outside our reasonable control.

4.2 We may provide links on our site to the websites of Hirers and other companies or organisations, whether affiliated with us or not. We have no control over the contents of those sites or the resources contained in them, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

4.3 Except as set out in these terms and conditions, all warranties, representations and other liabilities, whether express or implied, under statute or common law or otherwise, and whether other the law of contract or otherwise (and including liability for negligence) are hereby excluded to the extent permitted by law.

4.4 Our liability for losses you suffer as a result of us breaching any obligation or duty to you (including for negligence) is strictly limited to £500.

4.5 Without prejudice to the other exclusions and limitations in this clause, we are not in any event responsible for indirect losses, including but not limited to:

  • loss of income or salary
  • emotional distress however described
  • wasted time however arising
  • travel or accommodation costs
  • and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

4.6 This clause 4 does not include or limit in any way our liability:

  • For death or personal injury caused by our negligence;
  • For fraud or fraudulent misrepresentation; or
  • For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

5. PRIVACY AND INFORMATION ABOUT YOU

5.1 Your attention is drawn to Cambridge Network Limited’s Privacy Policy www.cambridgenetwork.co.uk/about-us/disclaimer/ which will apply to personal data we may collect from you in connection with the Services and which you are deemed to acknowledge and accept by accepting these terms and conditions. These terms and conditions will prevail in the event of any conflict between these terms and conditions and that privacy policy.

5.2 We will comply with applicable legal requirements in relation to the confidentiality of your information and, in particular, will not disclose any information relating to you except:

  • for the purpose of providing our Services;
  • as legally required, including without limitation informing a Hirer of information indicating that you are or may be unsuitable for a position in which you have been employed by the Hirer;
  • for the purposes of any legal proceedings (including arbitration); and
  • for disclosure to any professional body of which you are a member.

5.3 We will not disclose any information relating to you to your current employer without your prior consent.

6. TERMINATION OF REGISTRATION

6.1 You agree that the performance of our Services will begin immediately upon acceptance of your registration by us and, unless you and we agree otherwise, you will not be able to effect any cancellation under the Consumer Protection (Distance Selling) Regulations 2000 once the performance of those Services has begun.

6.2 You may however at any time notify us that you wish to withdraw your registration by email to recruitmentgateway@cambridgenetwork.co.uk in which case we shall cease to provide Services to you and shall cease to submit your information to Hirers. In order to help ensure our database remains as current as possible, we will write to you periodically to check that you are still seeking work and to refresh your information. If you inform us that you are no longer seeking work, or do not respond to our communication, we will terminate your registration.  We also reserve the right to terminate your registration for any other reason whatsoever in which case also we shall cease to provide Services to you and shall cease to submit your information to Hirers.

6.3 It is our policy to remove your details from our database following withdrawal or termination of registration as set out above.

WRITTEN COMMUNICATIONS AND NOTICES

7.1 Some of the information or communications we send to you are legally required to be in writing.  When using our site, you accept that communication with us will be mainly electronic.  We will contact you by e-mail or or text message or provide you with information by posting notices on our site.  You agree to these electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that those communications be in writing.  This condition does not affect your statutory rights.

7.2 All notices given by you to us must be given to Cambridge Network Limited at recruitmentgateway@cambridgenetwork.co.uk. We may give notice to you at either the e-mail or postal address you provide to us when registering with us, or in any of the ways specified in clause 7.1 above.  Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail or text is sent, or three days after the date of posting of any letter first class within the United Kingdom or seven days after posting by airmail if international.  In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

8. TRANSFER OF RIGHTS AND OBLIGATIONS

8.1 These terms and conditions and any contract between you and us are binding on you and us and on our respective successors and assigns.  You may not transfer, assign, charge or otherwise dispose of any contract with us, or any of your rights or obligations arising under it, without our prior written consent.  We may transfer, assign, charge, sub-contract or otherwise dispose of any contract with you, or any of our rights or obligations arising under it, at any time during the term of the contract.

9. WAIVER

9.1 If we fail at any time to insist upon strict performance of any of your obligations, or if we fail to exercise any of the rights or remedies to which we are entitled under these terms and conditions or otherwise, this shall not constitute a waiver of those rights or remedies and shall not relieve you from compliance with your obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with clause 7.2 above.

10. SEVERABILITY

If any of these terms and conditions or any provisions of any contract with you are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, the relevant term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions, which will continue to be valid to the fullest extent permitted by law.

11. ENTIRE AGREEMENT

These terms and conditions and any document referred to in them constitute the whole agreement between us and supersede any previous arrangement, understanding or agreement between us. We each acknowledge that, in entering into any contract or other legal relationship with each other, neither of us relies on any statement, representation, assurance or warranty of any person other than as expressly set out in these terms and conditions. Nothing in this clause shall limit or exclude any liability for fraud.

12. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force at the time that you register with us, unless:

any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to your previous registration), or if we notify you of the change to those policies or these terms and conditions (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the notification).

13. LAW AND JURISDICTION

These terms and conditions and any contracts arising from the use of or registration for Services and any dispute or claim arising out of or in connection with any of the above (including non-contractual disputes or claims) will be governed by English law and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
